DePuy is Conceding that Explants Should Belong to ASR Recipients
Last August, ninety-three thousand units of defective ASR XL Acetabular System and ASR Hip Resurfacing System were recalled by orthopedic device manufacturer DePuy. After the recall, hundreds of ASR victims have sought legal expertise and filed damages against the company.
Usually, patients who have been through a revision surgery and were not given their explanted hip replacement devices wonder what happened to the implants. Some say that their surgeons , without consent from their patients, destroyed or threw the hip implants away. There were even some who claim that DePuy representatives were present during the surgical procedure itself and took the removed hip replacement back to DePuy. These were the affairs raised by involved parties in the conference held last February 8 before Federal District Court Judge David Katz, who is presiding over the multidistrict litigation of the DePuy lawsuits, all of which reaches hundreds. Thousands of DePuy hip replacement victims have closely followed its progress.
The conference had lawyers representing Johnson & Johnson, parent company of DePuy, who stated the following regarding explanted ASR hip devices, “[the defendants are]committed to working out a protocol that both sides will agree to.” The court and the media were told by a DePuy spokesperson that, “[the defendants are]committed to working out a protocol that both sides will agree to.” Recipients of the ASR hip replacements were also assured that no legal rights will be waived against the manufacturer, DePuy and Johnson & Johnson.
Most recipients’ worries will be decreased because product liability lawyers were concerned that patients who wanted to file lawsuits against DePuy would not be able to do so since their explanted devices and other evidence might be taken into possession by the company.
